GENERAL PRIVACY INFORMATION

Pursuant to art. 13 and 14 of EU Regulation no. 2016/679 (hereinafter, “GDPR”), we inform you that the processing of the data you provide will be carried out with methods and procedures aimed at ensuring that the processing of personal data is carried out in compliance with fundamental rights and freedoms, as well as with dignity of the data subject, with particular reference to confidentiality and security, personal identity and the right to protection of personal data.

We remind you that by treatment we mean any operation or set of operations, carried out with or without the aid of automated processes and applied to personal data or sets of personal data, such as the collection, registration, organization, structuring, storage , adaptation or modification, extraction, consultation, use, communication by transmission, dissemination or any other form of making available, comparison or interconnection, limitation, cancellation or destruction ( art.4 GDPR).

1 – OBJECT OF THE TREATMENT

The data processed by Nichelcrom Acciai Inox S.p.A. they refer to:

– Personal and identification data, such as company name, VAT number, addresses, contacts;

– Data necessary for billing and payment, such as IBAN code;

– Contacts relating to the representatives who interact with Nichelcrom Acciai Inox S.p.A .;

– Data relating to the creditworthiness of customers.

2 – PURPOSE OF THE TREATMENT

Personal data and any changes that will be communicated in the future to Nichelcrom Acciai Inox S.p.A. are collected and processed for the following and exclusive purposes:

2.1 Purposes related to the execution of the contract, based on the legal obligation to which the Data Controller is subject (to fulfill the obligations arising from the contract):

– Economic and legal treatment of customers and suppliers under the existing contract;
– Organization and execution of the operational activities covered by the contract;
– Fulfillment of accounting, administrative and tax legal obligations;
– Any formalities provided for by Legislative Decree 81/08 regarding health and safety at work;
– Management of correspondence and communications;
– Check satisfaction with the quality of the products and services offered.

2.2 Purposes related to promotional and marketing operations, only with your specific and distinct consent (Article 7 of the GDPR), in particular:

– commercial communications and / or advertising material on products or services offered by the Data Controller, via newsletter sent by email.

We inform you that if you are already a customer, we can send you commercial communications relating to the Controller’s services and products similar to those you have already used, unless your consent is revoked (Article 7 of the GDPR).

3 – METHOD OF TREATMENT

The processing is limited to the following operations and in the following ways:

– Collection of data from the interested party, by filling in paper forms or company applications;
– Recording and processing on computerized and paper support;
– Organization of archives in a mainly automated form, through company applications and computerized personal data.

The data will be processed using suitable tools to ensure its confidentiality, integrity and availability. The processing is carried out on paper and through information and / or automated systems and will include all the operations or set of operations provided for in art. 4 of the GDPR and necessary for the processing in question, including communication to the subjects in charge of the processing itself. The data in question will not be disseminated, while they will or may be disclosed to public or private entities operating within the scope of the purposes described above. The Data Controller will process personal data for the time necessary to fulfill the aforementioned purposes and in any case for no more than 10 years from the termination of the contract.

4 – ACCESS TO TREATMENT

The treatment can be performed, as well as by the Data Controller, also by persons authorized to process the processing within the scope of the assigned tasks. Personal data will not be disclosed in any way, they may also be communicated and processed by third parties appointed and duly appointed as Data Processors:

– Banking institutions for the purpose of the economic treatment of customers and suppliers;
– Social security institutions for the purpose of fulfilling all social security, welfare and insurance obligations;
– Companies or Entities which, on behalf of Nichelcrom Acciai Inox S.p.A., provide specific instrumental or support services, including credit recovery services;
– Subjects whose right to access your personal data is recognized by law or secondary or community legislation.

In any case, the data will not be disclosed to unauthorized third parties or disseminated in any way. To this end, the processing is conducted with the use of security measures suitable to prevent unauthorized access to data by third parties and to ensure its confidentiality

5 – COMMUNICATION OF DATA

The Data Controller may communicate your data for the purposes referred to in point 2, without the need for express consent, to the following subjects:

– Supervisory bodies, judicial authorities, control bodies
– Other subjects whose right to access your personal data is recognized by provisions of law or secondary or community legislation.

6 – TRANSFER OF DATA

The management and storage of personal data will take place on servers located within the European Union of the Data Controller and / or third-party companies appointed and duly appointed as Data Processors. The servers are currently located in Italy. The data will not be transferred outside the European Union.

7 – NATURE OF DATA CONFERENCE AND CONSEQUENCES OF REFUSAL TO ANSWER

The provision of data for the purposes referred to in point 2.1 is mandatory. In their absence, it will not be possible to proceed with the signing or execution of the contract.
The provision of data for the purposes referred to in point 2.2 is optional.

8 – RIGHTS OF THE INTERESTED PARTY

According to the provisions of the GDPR, the interested party has the following rights towards the Data Controller:
– obtain confirmation as to whether or not personal data concerning him is being processed and, in this case, to obtain access to personal data (Right of access art. 15);
– to obtain the correction of inaccurate personal data concerning him without undue delay (Right of Rectification Article 16);

– obtain the cancellation of personal data concerning him without undue delay and the data controller is obliged to cancel the personal data without undue delay, if certain conditions are met (Right to be forgotten, Article 17);
– obtain the limitation of processing in certain cases (Right to limitation of processing art.18);
– receive in a structured format, commonly used and readable by an automatic device, the personal data concerning him provided and has the right to transmit such data to another Data Controller, without impediments by the data controller to whom he provided them , in certain cases (Right to data portability art.20);
– oppose at any time, for reasons connected with his particular situation, to the processing of personal data concerning him (Right to object, Article 21);
– receive without undue delay communication of the violation of personal data suffered by the Data Controller (Article 34);
– withdraw the consent expressed at any time (Conditions for consent art.7).

Where applicable, the interested party also has the rights referred to in Articles 16-21 GDPR (Right of rectification, right to be forgotten, right to limitation of processing, right to data portability, right of opposition), as well as the right of complaint to the Guarantor Authority
